or devices on the telecommunications network for the purpose of obtaining information
through illegal means. ... "
From
the explanation above, we can see that wiretapping is an action to obtain
unauthorized information in various ways. This is important to understand,
because Law No. 36/1999, expressly prohibits information tapping through
telecommunications networks in any form (Article 40). The criminal provision
for wiretapping is 15 (fifteen) years in prison.
This
is clear, we can find in Article 56 of Law No. 36/1999, it states that:
"Anyone who violates the
provisions referred to in Article 40 shall be sentenced to a maximum
imprisonment of 15 (fifteen) years."
Thus,
according to Law No.36 / 1999 the act of "tracing a cellphone" is not
included in the category of wiretapping, because essentially tapping uses
additional equipment on the telecommunications network, with a view to
obtaining information.
However,
to "track cellphones" by accessing an electronic system without
rights or by means of breaking the law is also prohibited.
According
to Law Number 11 Year 2008 Concerning Information and Electronic Transactions
(Law No.11 / 2008), as amended by Law Number 19 Year 2016 concerning Amendments
to Law Number 11 Year 2008 Concerning Information and Electronic Transactions
(Law No.19 / 2016).
As
stated in Article 30 of Law No.11 / 2008, namely:
1.
Any person intentionally and without right or
unlawfully accessing another person's Computer and / or Electronic System in
any way.
2.
Everyone intentionally and without right or
unlawfully accesses Computers and / or Electronic Systems in any way for the
purpose of obtaining Electronic Information and / or Electronic Documents.
3.
Any person who intentionally and without rights
or unlawfully accesses Computers and / or Electronic Systems in any way by
violating, breaking into, surpassing, or breaking into security systems.
Against
this act, the threat of punishment also varies, ranging from a maximum of 6
(six) years to 8 (eight) years in prison. The provisions can be found in
Article 46 of Law No.11 / 2008, namely:
1.
Every person who fulfills the elements referred
to in Article 30 paragraph (1) shall be sentenced to a maximum imprisonment of
6 (six) years and / or a maximum fine of Rp. 600,000,000.00 (six hundred
million rupiah).
2.
Every person who fulfills the elements referred
to in Article 30 paragraph (2) shall be sentenced to a maximum imprisonment of
7 (seven) years and / or a maximum fine of Rp. 700,000,000.00 (seven hundred
million rupiah).
3.
Every person who fulfills the elements referred
to in Article 30 paragraph (3) shall be sentenced to a maximum imprisonment of
8 (eight) years and / or a maximum fine of Rp.800,000,000.00 (eight hundred
million rupiah).
In
relation to wiretapping, according to the regulation, in addition to Law No.36
/ 1999, it is also included in prohibited acts or actions.
This
can be found in Article 31 Paragraph (1) of Law No.19 / 2016, stated that:
"Everyone intentionally
and without right or unlawfully intercepts or intercepts Electronic Information
and / or Electronic Documents in a particular Computer and / or Electronic
System that belongs to someone else."
Although,
indeed in the general provisions of Law No.19 / 2016, it is also not mentioned,
regarding the notion of wiretapping. However, in the explanation of Article 31
Paragraph (1) of Law No.19 / 2016, it is stated that Interception or
wiretapping is an activity to listen, record, deflect, change, hinder, and / or
record the transmission of Electronic Information and / or Electronic Documents
that are not of a nature public, whether using wired communication networks or
wireless networks, such as electromagnetic emission or radio frequency.
Criminal
sanctions for wiretapping or interception according to Law No.11 / 2008
specifically Article 47, that:
"Every person who fulfills
the elements referred to in Article 31 paragraph (1) or paragraph (2) shall be
sentenced to a maximum imprisonment of 10 (ten) years and / or a maximum fine
of Rp.800,000,000.00 (eight hundred million rupiah)."
So,
we can see that the sanction of wiretapping according to Law No.11 / 2008 is
lower when compared to the criminal provisions in Law No.36 / 2009. However, it
is clear that the action of wiretapping is an act that is expressly prohibited
by law, except as clearly stated otherwise.
Exceptions
to criminal penalties for wiretapping are actions related to law enforcement,
meaning that wiretapping can be done for the purpose and purpose of law

This
assertiveness can be found in Article 31 Paragraph (3) of Law No.19 / 2016,

"The provisions referred

wiretapping authority is the Corruption Eradication Commission (KPK). Because

Commission (Law No.30 / 2002), Article 12 clearly states one of the KPK's
authorities to conduct wiretapping and recording conversations.
Accordingly,
all acts of wiretapping or accessing the Electronic System in any way for the
purpose of obtaining Electronic Information and / or Electronic Documents
without permission. In addition to authorized officials and for law enforcement
